Terms of Sale

These Terms of Sale govern the purchase of a Thermal Canary Pro license from Sébastien Vérité EI ("we", "us"). By completing a purchase, you agree to these terms.

1. The Product

Thermal Canary Pro is a paid extension for the free, open-source Thermal Canary desktop application for Linux. It unlocks additional features (crash forensics, throttle diagnosis, session history, and more, as described on our pricing page) inside the same application, via a license key.

Thermal Canary Pro is delivered as digital content: a downloadable software license, with no physical goods involved.

2. Price and Payment

The current price is €59. We currently sell under the French VAT exemption scheme for small businesses (franchise en base de TVA, article 293 B of the French tax code), so no VAT is added to this price. If this changes, the VAT amount applicable to your billing country will be calculated by Stripe Tax and shown as a breakdown at checkout.

Payments are processed by Stripe, our payment processor. Stripe collects your payment information directly. No VAT is currently charged on purchases (see the pricing section above); once VAT registration is required, Stripe Tax will calculate and collect the VAT or sales tax applicable to your billing country at checkout. We are the seller of record for the transaction: we issue your receipt, remain responsible for reporting and remitting any applicable tax to the relevant authorities, and are the counterparty for payment disputes and chargebacks.

3. License Grant

A Thermal Canary Pro license, once purchased, grants you:

• A perpetual license to use Thermal Canary Pro with every release of the current major version (v1.x) of the application, on one machine at a time.
• One concurrent activation. Activating your key on a new machine automatically releases the license from any previously activated machine (for example after a reinstall or a hardware swap), without needing to contact support.
• Access to a 14-day offline grace period: the app keeps working without an internet connection for up to 14 days after its last successful license-status check.

A future major version (v2) will be offered as a separate paid upgrade, at a reduced price for existing license holders. Your v1 license is not affected by the release of v2 and continues to unlock every v1.x release indefinitely.

The license is personal and non-transferable to a third party. It does not grant any right to the source code of Thermal Canary Pro, which remains proprietary (unlike the free Thermal Canary application, which is separately licensed under the MIT license).

4. Delivery

There is nothing to ship: after payment, we email you a license key (Stripe notifies our license server of the sale, then we send the key ourselves) and you activate it directly inside the Thermal Canary application. 6. Warranty and Liability

Thermal Canary Pro is monitoring and reporting software, not a safety device. It cannot prevent hardware damage. The app displays temperature readings, FPS metrics, and alerts based on sensor data, but it does not control your hardware and it cannot shut down your system to protect it. Do not rely on it as a safety limit or as a substitute for manufacturer-specified safe operating limits or your own judgement.

The software is provided "as is". We make reasonable efforts to keep it working correctly across common Linux distributions and hardware configurations, but we cannot guarantee compatibility with every possible setup. Sensor readings can be wrong or missing. The alert toast may not appear over fullscreen games in some situations, and the Crash Black Box requires the app to be running and able to write to disk; a hard system lock may prevent any data from being saved. To the maximum extent permitted by applicable law, our liability for any issue arising from the use of the software is limited to the amount you paid for your license. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable French or EU consumer protection law.

7. Support

Support requests can be sent to . We aim to respond within a reasonable timeframe but do not offer a guaranteed service-level agreement.

8. Governing Law

These Terms of Sale are governed by French law. If you are a consumer resident in the European Union, you also benefit from any mandatory consumer protection provisions of your country of residence. In case of a dispute, you may use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr/
